Resumo
Introdução: A utilização da máquina do Poder Judiciário com enfoque no fornecimento pontual de medicamentos é tema bastante polêmico que envolve, por um lado, o direito individual à saúde e, por outro, o direito coletivo à organização dos serviços de saúde e definição das linhas de cuidado e dos medicamentos essenciais acessíveis por toda a população. O Ministério Público (MP) é uma instituição autônoma do Estado que não está subordinada aos Poderes Legislativo, Executivo ou Judiciário. Seu papel é zelar pela ordem jurídica e fiscalizar a execução das leis em diversas esferas. Neste contexto, a Secretaria de Saúde do Recife (SESAU), mais especificamente a Assistência Farmacêutica municipal enquanto prestadora de serviço de saúde é uma área que tem sido bastante pautada pelo MP de Pernambuco (M P-PE). Tal situação tem sido cada vez mais recorrente devido, principalmente, ao fenômeno da judicialização da saúde. Objetivos: Analisar o perfil dos ofícios emitidos pelo M P-PE à SESAU envolvendo a Assistência Farmacêutica nos anos de 2016 e 2017. Métodos: Estudo descritivo, retrospectivo, de modalidade exploratória com abordagem quantitativa. Foram revisados todos os ofícios recebidos pela AF em 2016 e 2017 e observados: o tipo de instrumento jurídico - inquérito civil (IC), notícia de fato (NF), procedimento preparatório (PP) ou procedimento administrativo (PA), categoria de solicitações de acordo com o objeto – medicamentos, materiais médico-hospitalares (MMH), suplementos alimentares (SA) e outros (quando não há especificação do objeto, a demanda não é de responsabilidade da AF ou usuário oriundo de outro município), caráter da ação - individual ou coletivo, número de itens pautados por ofício, e perfil do medicamento - componente básico (CBAF), componente estratégico (CESAF) e componente especializado (CEAF). Os dados foram organizados em planilha Excel. Resultados: Em 2016 a AF recebeu 43 ofícios. Destes, 65,12% foram do tipo NF, 20,93% PP e 13,95% IC. Em relação ao tipo de ação, 69,76% dos ofícios tiveram caráter individual enquanto 30,24% coletivo. Constaram em média 2,08 itens por ofício, sendo que em 49,53% dos ofícios houve solicitação de SA, em 37,21% de medicamentos e em 23,25% de MMH, 18,6% dos ofícios foram categorizados como “outros”. Em relação ao perfil dos medicamentos, 10 ofícios constavam itens que faziam parte do CBAF, 1 do CEAF e 1 do CESAF. Já em 2017, a AF recebeu 57 ofícios, um aumento de 32,55% em relação a 2016. Destes, 62,07% eram NF, 36,21% PA e 1,72% foram do tipo IC, não houve ofício de PP. Em relação ao caráter da ação, 82,76% dos ofícios tiveram caráter individual e 17,24% coletivo. Constaram em média 2,17 itens por ofício, sendo a maioria dos ofícios solicitações de medicamentos (72,4%), seguido de SA (24,18%) e MMH (22,41%). Apenas um ofício foi categorizado como “outros”. Em relação aos medicamentos, 33 ofícios constavam itens do CBAF, 4 do CEAF. Conclusão: Percebe-se aumento significativo de ações, sendo estas majoritariamente individuais e do tipo NF e a AF como referência para solicitação de suplementos alimentares. Ressalta-se a importância da construção de uma relação de diálogo e parceria entre o M P-PE e a SESAU diante do fenômeno da judicialização da saúde.

Introduction: The use of the Judiciary system to obtain timely provision of medications is a highly controversial topic involving individual rights to health care versus collective rights to organized health services and accessibility to essential medications for the entire population. The Public Ministry (MP) is an autonomous institution of the State not subordinated to the Legislative, Executive, or Judiciary branches. Its role is to uphold legal order and oversee law enforcement across various spheres. In this context, the Municipal Health Department of Recife (SESAU), specifically its Pharmaceutical Assistance division as a healthcare service provider, has been a focal point for the Public Ministry of Pernambuco (MP-PE). This situation has become increasingly common due to the phenomenon known as health judicialization. Objectives: To analyze the profile of official communications issued by the MP-PE to SESAU involving Pharmaceutical Assistance in the years 2016 and 2017. Methods: This is a descriptive, retrospective study with an exploratory approach and quantitative analysis. All communications received by Pharmaceutical Assistance in 2016 and 2017 were reviewed. The following aspects were observed: type of legal instrument - civil inquiry (IC), factual notice (NF), preparatory procedure (PP), or administrative procedure (PA); categories of requests based on the object – medications, medical-hospital materials (MMH), nutritional supplements (SA), and others (when there is no specification of the object, the demand is not the responsibility of Pharmaceutical Assistance or involves users from other municipalities); nature of the action - individual or collective; number of items per communication; and profile of medications - basic component (CBAF), strategic component (CESAF), and specialized component (CEAF). Data were organized using Excel spreadsheets. Results: In 2016, Pharmaceutical Assistance received 43 communications. Of these, 65.12% were NF, 20.93% PP, and 13.95% IC. Regarding the nature of the action, 69.76% of communications were individual and 30.24% were collective. On average, there were 2.08 items per communication, with 49.53% of communications requesting SA, 37.21% medications, and 23.25% MMH. Additionally, 18.6% of communications were categorized as "others". Regarding the profile of medications, 10 communications included items from CBAF, 1 from CEAF, and 1 from CESAF. In 2017, Pharmaceutical Assistance received 57 communications, representing an increase of 32.55% compared to 2016. Of these, 62.07% were NF, 36.21% PA, and 1.72% were IC; there were no PP communications. In terms of the nature of the action, 82.76% were individual and 17.24% were collective. On average, there were 2.17 items per communication, with the majority requesting medications (72.4%), followed by SA (24.18%), and MMH (22.41%). Only one communication was categorized as "others". Regarding medications, 33 communications included items from CBAF and 4 from CEAF. Conclusion: There is a significant increase in actions, predominantly individual and of the NF type, with Pharmaceutical Assistance serving as a reference for requests for nutritional supplements. It highlights the importance of building a dialogue and partnership between MP-PE and SESAU in addressing the phenomenon of health judicialization.
