Abstract
Introduction: The Unified Health System must guarantee universal, full and equal access to all Brazilians, and the National Pharmaceutical Assistance Policy is one of the actions to guarantee access to medicine. The List of Essential Medicines is one of the strategies to optimize access to medicine and, consequently, rationalize financial resources. The medicines available in the SUS are not always able to meet all the health needs of the population, which increases the judicialization of health. Judicialization has a negative budgetary impact, since, due to the speed of compliance with court decisions, it leads to purchases without bidding, with the acquisition of more expensive medicines. The objective of this study is to identify the pharmacoeconomic profile of medicines subject to judicialization at the Health Department of the Federal District (SESDF). Methods: This is a retrospective study that aims to analyze the profile and budgetary impact in 2022 regarding the judicialization of medicines at the SESDF. The data used were taken from the Inventory Management System (Sis-materials), including only medications made available to the Judicial Outpatient Pharmacy Center, and were processed by the Microsoft Excel program. Results: SESDF has approximately 1,333 patients in the Judicial Outpatient Pharmacy, with 265 items of materials and judicialized medications. Approximately 25% refer to standardized medications and 75% to non-standardized medications. In 2022, R$38,562,023.27 were spent, with 11% of the expenses related to standardized medications. Discussion and conclusions: The vast majority of the judicialized standardized list refers to patients not covered by the Clinical Protocol and Therapeutic Guidelines (PCDT) or medications that have not yet been purchased by the Ministry of Health, such as Nusinersen. Among the non-standard drugs that consume a large part of the budget spent on judicialization are Pirfenidone, Nintedanib, ocrelizumab and ruxolitinib, the first three drugs being related to the treatment of chronic diseases, such as Pulmonary Cystic Fibrosis and Multiple Sclerosis. The four together consumed approximately 29.4% of the budget to serve only 13% of the patients judicialized in 2022. The four drugs have already been analyzed by CONITEC, which did not recommend their incorporation. It is clear that judicialization is not a determining factor for the incorporation of these technologies within the scope of the SUS. It is worth noting that the relationship between the incorporation of a drug with a specific disease ICD also strengthens judicialization, since it refers to patients who do not meet the inclusion criteria of the PCDTs. Therefore, the incorporation of the drug linked to the ICD favors the judicialization of health, since the judicial system does not understand the criteria used in the ATS. In the future, a reanalysis of these technologies would be relevant, since there may be new clinical studies that can corroborate the benefit of using these drugs and improve the health outlook of patients with rare and incurable diseases. Understanding the pharmacoeconomic profile of the drugs subject to judicialization can support the development of state strategies to reduce the judicialization of drugs in the SUS and optimize health resources at the state level.
